Ho Chi Minh City – 14 November 2013 – AmCham HCMC ICT event was held successfully with 60 attendees during which Rick Yvanovich, Founder and CEO, TRG International, Chairman AmCham HCMC ICT group, Seck Yee Chung, Partner Baker & McKenzie, Vice-Chair AmCham HCMC ICT group and Nathan Lane, Economic Officer, US Consulate General, Ho Chi Minh City updated everyone on the IT regulations that an individual and a company ought to be aware about. Through a lively panel discussion they painted the larger picture contributing to the bigger regulatory IT framework that’s taking shape in Vietnam.
They stated the Top 5 IT regulations affecting business consisting of: Decree 72, Decree 52, Decree 174, Decree 181, and Decree X. Whilst a controversial law, Decree 72 had lost the media spotlight since its inception a year ago, however its recently gained the spotlight again with the issuance of one of the implementation circulars on OTT services. Despite the media attention that Decree 72 attracted, the upcoming Decree X: draft IT Services Decree, have potentially greater impact not only on IT businesses but also on those MNC’s who are providing IT services to themselves such as from the region or HQ and cross-charging for them.
According to the draft circular, foreign over-the-top (OTT) service providers are required to base at least one host server in Viet Nam and must have trade agreements with Vietnamese telecommunications companies licensed to provide Internet-based calls and texting messages. OTT enterprises which charge fees must follow regulations on fee management and service quality that are applicable to traditional telecommunications services in Viet Nam.
With the Draft IT Services Decree, Offshore service providers must designate a lawful agent in Vietnam on behalf of the cross-border IT service provider to deal with relevant issues before Vietnam's state bodies and provide the MIC with identity. Besides, Investors in the business of renewing and refurbishing hardware would be required to apply for a license from the MIC information of the lawful agent.
Finally, throughout this event, IT enterprises are hoped to understand and foresee the consequence of upcoming IT regulations on business so that they can raise their “voice” towards these challenging IT regulations.
